1. Platform Role & Intermediary Disclaimer

1.1. Technology Platform: RentKosovo operates strictly as a technology marketplace and software intermediary connecting independent car rental agencies ("Agencies") with retail customers ("Renters" or "Customers").

1.2. No Ownership of Vehicles: RentKosovo does not own, inspect, maintain, operate, or fleet any of the vehicles listed on the platform.

1.3. Direct Contractual Relationship: When a Renter books a vehicle on RentKosovo, the binding rental contract is established directly between the Renter and the specific Agency fulfilling the vehicle rental. RentKosovo is not a party to the rental contract signed at vehicle handover.

2. Booking & Payment Structure

2.1. Free Reservations: Reserving a vehicle on RentKosovo is free of charge to the Renter. No booking fees or online advance deposits are collected by RentKosovo during the online reservation process unless explicitly stated otherwise during checkout.

2.2. Direct Payment at Pickup: The Renter agrees to pay 100% of the total rental cost directly to the fulfilling Agency upon vehicle pickup. Accepted payment methods (cash, local/international credit or debit cards) are specified by each individual Agency.

2.3. Pricing Transparency: All rental rates displayed on RentKosovo are set directly by the respective Agencies.

3. Cancellations, Modifications, & Agency Obligations

3.1. Renter Cancellation Policy: Renters may cancel any confirmed reservation free of charge up to 48 hours prior to the scheduled pickup time directly through their RentKosovo account or by contacting support.

3.2. Agency Cancellations: If an Agency must cancel a confirmed reservation for any reason, the Agency is obligated to:

• Refund any advance payments or deposits directly collected (if applicable).
• Offer the Renter a comparable or upgraded alternative vehicle for the same agreed price, subject to the Renter's written or explicit approval.

3.3. Late Cancellations & No-Shows: No-show policies, grace periods for flight delays, and late pickup policies are defined individually by each Agency on their respective profile or listing pages.

4. Driver Eligibility & Documentation Requirements

4.1. Driving Experience: All drivers picking up a vehicle must have held a valid driver's license for a minimum of 2 consecutive years.

4.2. Required Documentation: At the time of pickup, the primary driver must present:

• A valid Driver's License recognized in the Republic of Kosovo.
• A valid Passport or official national ID card.
• Any additional identity verification or proof-of-residence documentation reasonably requested by the Agency during the booking or verification process.

4.3. Agency Right of Refusal: Agencies reserve the right to deny vehicle handover if the driver fails to meet minimum license history requirements, presents invalid or fraudulent documentation, or fails verification checks.

5. Agency Custom Policies (Mileage, Fuel, Cross-Border)

5.1. Individual Listing Terms: Fuel rules (e.g., Full-to-Full), daily mileage limits (e.g., unlimited vs. capped kilometers), and security deposit amounts are set directly by each Agency on their individual vehicle listings.

5.2. Cross-Border Travel: Driving outside the borders of the Republic of Kosovo (e.g., to Albania, North Macedonia, Montenegro, or other European nations) is an optional add-on service.

• Cross-border travel is strictly prohibited unless the specific Agency explicitly enables this feature on their listing.
• Where permitted, additional contract fees, border permits, or green card insurance charges are determined and specified by the Agency.

6. Security Deposits, Vehicle Damage, & Traffic Fines

6.1. Direct Security Deposits: Any security deposits (whether collected in cash or pre-authorized on a credit card) are managed 100% directly between the Renter and the Agency at vehicle handover. RentKosovo does not hold or process security deposits.

6.2. Damage Liability & Insurance: All vehicle condition assessments, collision damage waivers (CDW), insurance coverage options, traffic violations, parking fines, and damage repair claims are governed strictly by the physical rental contract signed between the Renter and the Agency at pickup.

6.3. Platform Release: RentKosovo assumes no liability for disputes, vehicle breakdowns, accidents, traffic violations, or financial claims arising from the physical use of any rented vehicle.

7. Customer Reviews & Content Ownership

7.1. Verified Reviews Only: Only Renters with completed and verified bookings on RentKosovo are eligible to submit reviews and star ratings for Agencies.

7.2. Media Rights & Intellectual Property: Agencies uploading vehicle photos, logos, or descriptions to RentKosovo guarantee that they hold all necessary intellectual property rights or licenses to such content.

7.3. Content Moderation: RentKosovo reserves the right to remove any user-generated reviews, photos, or comments that contain abusive language, hate speech, promotional spam, or verified false claims.

8. Account Suspension & Banning

8.1. Platform Integrity: RentKosovo reserves the right to immediately suspend, restrict, or permanently ban any Renter or Agency account that engages in:

• Fraudulent activity or identity misrepresentation.
• Repeated last-minute cancellations or false bookings.
• Abusive behavior toward RentKosovo staff or partner Agencies.
• Material breach of these Terms.

8.2. Cancellation of Active Bookings: Account suspension automatically cancels any pending or unfulfilled reservations associated with the blocked user.

9. Limitation of Liability

To the maximum extent permitted by applicable law, RentKosovo, its directors, employees, and software developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, travel delays, or personal injury—arising out of or in connection with your use of the platform or any agreement entered into with an independent Agency.

10. Governing Law & Jurisdiction

10.1. Applicable Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Kosovo.

10.2. Competent Courts: Any disputes, controversies, or claims arising out of or relating to these Terms or the use of RentKosovo shall be submitted to the exclusive jurisdiction of the competent courts in Pristina, Republic of Kosovo.
